Who is responsible for a Brooklyn sidewalk?
In New York City, property owners are responsible for maintaining and repairing the sidewalk next to their property. If DOT inspects and finds defects, such as cracked or loose flags, trip hazards or bad drainage slopes, it issues a Notice of Violation. Sidewalk work over $200 must be done by a DCWP-licensed contractor, and the contractor needs a DOT sidewalk construction permit.
Good news for many Brooklyn homeowners: the City no longer issues sidewalk violations for damage caused only by City street trees on 1-, 2- and 3-family homes. Tree damage next to buildings with 4 or more units, commercial properties or vacant lots is still the owner's job.
What's included
If the defects aren't fixed within 75 days of the notice, NYC DOT may do the repair itself and bill the property owner. The same 75 days is your window to appeal if you think the violation is wrong.

Who pays for sidewalk repair in Brooklyn?
In NYC the owner of the adjacent property is responsible for maintaining and repairing the sidewalk. We give you a fixed written quote before any work starts.
Is tree-root damage my responsibility?
On 1-, 2- and 3-family homes, the City no longer issues violations for damage caused only by City street trees. On larger residential, commercial or vacant properties it is still the owner’s responsibility. We tell you which applies at the inspection.
Do I need a permit to fix my sidewalk?
Yes. The contractor needs a DOT sidewalk construction permit, and sidewalk work over $200 must be done by a DCWP-licensed contractor. We handle the permit as part of the job.
How long does a sidewalk replacement take?
It depends on how many flags need replacing and whether there is curb or tree work. Your written quote includes the schedule, and new concrete needs time to cure before heavy use.
Will you get my violation dismissed?
Yes. Once the repair is done, a DOT dismissal inspection is booked with the permit and violation numbers. When the inspector confirms the work, the violation is removed.
